1. Acceptance of Terms
By accessing or using DutyScope (“the Service”), operated by Vanguard 360 Solutions SRL (“we”, “us”, “our”), you agree to be bound by these Terms of Service and all policies referenced herein. If you do not agree to these Terms, you must not access or use the Service.
2. Description of Service
DutyScope is a software-as-a-service (SaaS) platform that helps businesses organise and estimate their Extended Producer Responsibility (EPR) obligations across the European Union. The Service provides tools for obligation mapping across packaging, electronics (WEEE), batteries, and textiles; registration tracking; reporting management; fee estimation based on product and material data you enter; and team collaboration features. The Service is accessed via a web application at dutyscope.com.
3. EPR-Specific Disclaimers
Not Legal Advice. DutyScope is not a law firm, does not provide legal advice, and does not create an attorney-client relationship. The information provided by the Service is for informational purposes only. You should consult a qualified legal professional for advice specific to your compliance situation.
Not a PRO. DutyScope is not a Producer Responsibility Organisation (PRO), compliance scheme, take-back system, or Authorised Representative (AR) under any EU or national EPR legislation. The Service does not file registrations, declarations, or reports on your behalf, nor does it appoint an AR for you where required.
Estimates Only. Fee figures displayed in the Service are estimates based on publicly available fee schedules, the data you enter, and assumptions about material composition and quantities. Actual fees charged by PROs may differ. Always confirm with the relevant national authority or PRO before making financial commitments.
Regulatory Changes. EPR regulations change frequently at both EU and national levels. DutyScope makes reasonable efforts to keep its config data up to date but does not guarantee accuracy or completeness at any given time. Consult our full Legal Disclaimers for detailed coverage.
4. Account Registration and Responsibility
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately of any unauthorised use. One person or legal entity may not maintain more than one free- tier account. You represent that you are at least 16 years of age and have the authority to bind the organisation you represent to these Terms.
5. User Obligations and Data Accuracy
You are solely responsible for the accuracy of the data you enter into the Service, including product information, material declarations, weights, sales countries, and compliance documents. You are solely responsible for meeting all legal and regulatory EPR obligations applicable to your business, including but not limited to PRO registration, declaration submission, fee payment, and AR appointment.
6. Acceptable Use
You agree not to misuse the Service. Prohibited activities include:
- Using the Service for any unlawful purpose or in violation of applicable laws.
- Uploading malicious code, viruses, or any content designed to disrupt or damage the Service.
- Attempting to gain unauthorised access to the Service, other user accounts, or our infrastructure.
- Interfering with or disrupting the integrity or performance of the Service or third-party data contained therein.
- Reselling, sublicensing, or commercially exploiting the Service without our express written consent.
- Scraping, crawling, or systematically extracting data from the Service by automated means without our prior written permission.
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
7. Subscription, Billing, and Cancellation
Plans. DutyScope offers free and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis. All fees are displayed in EUR (€) and are exclusive of applicable VAT.
Payments. Payments are processed securely through Stripe. By subscribing, you authorise Stripe to charge your payment method for the applicable fees. You must maintain valid payment information.
Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. No refunds are issued for partial months.
Refunds. Fees are non-refundable except as required by applicable law. EU consumers have a 14-day right of withdrawal from the date of purchase for digital services, unless you expressly consent to immediate access and acknowledge loss of the withdrawal right.
Price Changes. We reserve the right to change our pricing with 30 days’ notice. Price changes apply to the next billing cycle. If you do not agree, you may cancel before the change takes effect.
8. Intellectual Property
Our IP. The Service, including its software, design, branding, logos, graphics, text, config engine, fee estimation algorithms, and all other intellectual property, is owned by Vanguard 360 Solutions SRL and protected by Romanian, EU, and international copyright, trademark, and intellectual property laws. All rights not expressly granted are reserved.
Your Data. You retain full ownership of all data, content, and documents you upload or create within the Service (“User Content”). You grant us a limited, worldwide, non-exclusive licence to host, store, and process your User Content solely as necessary to provide and improve the Service to you.
Feedback. Any suggestions, feature requests, or feedback you provide may be used by us without restriction or obligation.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Vanguard 360 Solutions SRL, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunity, or for fines, penalties, or losses arising from EPR non-compliance, even if advised of the possibility of such damages.
In no event shall our aggregate liability for any claim arising out of or related to these Terms or the Service exceed the total fees paid by you to DutyScope in the twelve (12) months immediately preceding the event giving rise to the claim.
The limitations in this section apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and shall survive termination of these Terms. Some jurisdictions do not allow certain limitations, so these limitations may not apply to you.
10. Third-Party Services
The Service may integrate with or link to third-party services (such as Stripe for payments, Google for authentication, PRO portals, and regulatory authority websites). We do not control and are not responsible for the content, privacy policies, or practices of any third-party services. Your use of such services is at your own risk and subject to their respective terms.
11. Termination
You may terminate your account at any time from your account settings. We reserve the right to suspend or terminate accounts that violate these Terms or applicable law. Upon termination, your right to access the Service immediately ceases. Your data will be deleted in accordance with our Privacy Policy, subject to legal retention obligations. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Bucharest, Romania. For EU consumers, this does not affect your mandatory rights under the law of your country of residence.
13. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via email and in-app notification at least 14 days before they take effect. Non-material changes may take effect immediately upon posting. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and cancel your account before the changes take effect.
